Terms of Service

Effective as of January 26th, 2025

Welcome to AceGuitar! By downloading, accessing, or using the AceGuitar mobile application ("the App"), you agree to these Terms of Service ("Terms"). If you do not agree with these terms, please do not use the App.

These Terms constitute a legal agreement between you ("User," "you") and AceGuitar ("we," "our," or "us"). Please read them carefully before using the app.

Eligibility

You must be at least 13 years old to use the App or create an account. By using the App or creating an account, you represent that you are 13 years of age or older.

Use of AceGuitar is prohibited where it violates local laws or regulations in your country.

Use of the App

You may:

  • Use AceGuitar for personal or educational purposes only.
  • Create Projects locally on your device or upload them to our cloud servers if an account is created.

You may NOT:

  • Reverse engineer, decompile, or attempt to extract source code from any part of the App.
  • Upload malicious content (e.g., viruses) through feedback submissions or Projects stored in our system.
  • Attempt unauthorized access into our systems or interfere with app functionality using automated tools (bots).
  • Claim affiliation with AceGuitar unless explicitly authorized in writing.
  • Exploit any possible vulnerabilities in feedback mechanisms or data submission features.

We reserve the right to terminate accounts and restrict access to users who violate these terms.

Accounts

Creating an account is optional but required for certain features such as syncing Projects across devices via Firebase Firestore cloud storage.

When creating an account, you are responsible for maintaining confidentiality of login credentials.

We reserve the right to suspend or permanently terminate your account at our discretion if we determine that:

  • You violate these Terms;
  • Your actions harm other users or compromise App security;
  • You engage in illegal activity through AceGuitar;

If you wish to delete your account permanently:

Content Ownership & Licenses

Your Content

Any Projects created within AceGuitar remain solely yours unless explicitly shared otherwise by written agreement with us. By uploading Projects through your account:

  • You grant us a non-exclusive license solely for purposes related to providing cloud-based storage services (e.g., enabling cross-device access). We do not claim ownership over your work.

Our Content

All intellectual property rights in AceGuitar—including but not limited to software code, graphics, logos, and instructional materials—are owned by us unless stated otherwise. Users may not reuse this content outside personal use without prior written approval.

Data Usage & Privacy

Your data will be handled in accordance with our Privacy Policy, which explains how we collect and process personal information like email addresses during account creation as well as anonymized analytics data via Google Analytics/Firebase Crashlytics.

Please note: Even without an account, certain anonymized usage data may still be collected automatically for performance improvements and diagnostics.

Limitation of Liability

To the fullest extent permitted by law:

  1. AceGuitar disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose.
  2. AceGuitar shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of or related to your use of the App—including but not limited to loss of Projects or other stored content—even if we have been advised of the possibility of such damages.
  3. In jurisdictions where limitations on liability are prohibited, our liability shall not exceed the amount you paid (if applicable) for access to AceGuitar in the six months preceding any claim.

Force Majeure

We are not liable for delays or failure to perform due to causes beyond our reasonable control—including but not limited to acts of nature (earthquakes, fires, floods), labor disputes, government actions, power outages, internet disruptions, cyberattacks on third-party providers (including Firebase), or other force majeure events.

Governing Law

These Terms of Service shall be governed by the laws of Canada.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary while preserving the remaining provisions.

Updates to these Terms

We may update these terms. In case of significant updates, we may inform users by email or within the App. Continued use after updates to the terms constitutes acceptance of the updates. The latest version of the Terms can always be found at aceguitar.app/terms.
